3. Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Arbitration shall take place in Dallas, Texas. The arbitrator shall apply Texas law. Judgment upon any arbitration award may be entered in any court of competent jurisdiction.

Exceptions: Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent irreparable harm pending arbitration.

To the extent any provision of this arbitration agreement is found unenforceable, such provision shall be severed and the remaining provisions shall continue in full force.
